Required Legal Notice

Any wine sold to you from CATO'S WINE CELLAR is sold in California and title passes to you, the buyer, in California. All orders are shipped by a licensed California retailer. The buyer is solely responsible for shipment of wine. We make no representation concerning your legal rights to ship or receive wine into any state outside of California or into any country outside of the United States. In fact, there are certain states and countries that we cannot ship to. By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to your selected destination.

You must be 21 years or older to buy wine. By placing your order with CATO'S WINE CELLAR you certify under penalty of perjury that you and the recipient are at least 21 years old. When the wine is delivered, the recipient will be required to show identification proving that he or she is at least 21 years old. The willful misrepresentation of your age or the age of the recipient is a crime in most states, and if you willfully misrepresent your age or the age of the recipient, CATO'S WINE CELLAR will cooperate with authorities to prosecute you to the fullest extent of the law.

 


Shipping Rates and Procedures


We make no representation to the legal rights of anyone to ship or import any wines into any state outside of NY State. The buyer is solely responsible for shipment of wines. By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to you. Title to all wine purchases passes to the purchaser at our premises in Syosset, NY.

When ordering from us you are representing to us that you are at least 21 years of age and that the person to whom it is being shipped is also at least 21 years old. An adult signature will be required upon delivery.

We do not ship to: P.O. Boxes, APO addresses, Hospitals, Military Bases, Colleges, Cruise Ships and Hotels.

We do not ship internationally and to the following states: Florida, Indiana, Kentucky, Maryland, Massachusetts, New Hampshire, Pennsylvania, Virginia, Tennessee, Utah. Non-wine items, such as accessories and glassware may be shipped to all states.

IMPORTANT NOTE - If you are shipping a gift from any of these states to a a state that we can ship to, you must call 888-614-WINE(9463) to place your order.

Certain states have restrictions on the quantity of bottles that can be ordered. We strictly adhere to the state liquor authority laws. We will notify you via email if your order cannot be fulfilled due to this restriction.

Most orders are processed the same day as the online entry of your order. We can usually ship your order within 1 to 3 business days. Depending on your location, the shipment will then take an additional 1-5 days in transit. If for any reason there are delays onger than that, we will notify you immediately via email.

We are shipping 2 day air, 3 day air and ground to all locations (except HI and AK - 2 day air only). Our shipping is done in containers that hold 1, 2, 3, 4, 6, or 12 bottles of wine. To make the most of your shipping dollar, you should order in those quantities as a 7 bottle order will ship in a 12 bottle container and cost about the same to ship.

HI & AK customers are excluded from any of our free shipping offers and promotions. We will notify you of the exact shipping cost when we process your order.


Adult Signature

AN ADULT SIGNATURE IS REQUIRED BY LAW FOR ALL DELIVERIES! If no one is available to receive the package, a subsequent attempt to deliver will be made by the carrier. If subsequent attempts are unsuccessful, your order will be returned to us form where it originally shipped from.

We adhere and comply to all federal, state, and local laws regarding sale of alcohol to minors. We have clearly mentioned in our policies throughout the website that no purchase can be made by anyone under 21 years of age. The customer are required by law to provide date of birth that verifies age when creating an account with us. All shipments require an adult signature; proof of age will be verified by delivery carrier.


Vintage Replacements

On occasion, certain vintages will sell out or will have been replaced by a new release. When this occurs we will notify you by email.Please note, that due to availability, we reserve the right to substitute a comparable vintage for wines under $30.


Insurance
We automatically add insurance to all the orders placed online. This covers you from any package lost or damaged in transit.

Return Policy

We guarantee our product quality and service. Customer satisfaction is our moto. If for any reason you are not satisfied with your order, please contact our customer service: cato@catoswinecellar.com.

We charge a 20% restocking fee on all cancelled or returned orders


Credit Card Refunds

We will process a refund to the credit card used at time of purchase, once we have received the returned shipment. Please allow at least two billing cycles for the refunds minus the restocking fee to appear on your statement.

All bottles 10 years or older are purchased at the buyer's own risk.


Tracking Your Order

We email you the tracking number associated with your shipments the day the order is in transit. You can also sign-in and click on Order Status page to check the status of your delivery by Tracking Number for your most recent order. Please note that it may take 12 - 24 hours before tracking information appears on the carrier's web site.

Orders are delivered Monday through Friday, excluding holidays. All express orders placed by 11:59 PM EST will be shipped next business day. Your credit card authorization and verification must be received prior to processing your order. We will notify you via email if there are any delays in your orders beyond our control.
